You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these obligations.

4. Prohibited Activities

User agrees to not use the Platform for illegal activities or any purpose that violates these Terms. Prohibited activities include, but are not limited to:

• Creating content that is illegal, harmful, threatening, abusive, or offensive
• Violating intellectual property rights of others
• Attempting to gain unauthorized access to the Platform or other users' accounts
• Distributing malware, viruses, or other harmful code

5. Payment and Refunds

No refunds will be provided to the user for any purchases made on the Platform, including but not limited to credit packages, subscription fees, or premium features. All sales are final.

Credits purchased on the Platform are non-transferable and non-refundable. Unused credits will expire according to the terms specified at the time of purchase.

6. Intellectual Property Rights

The Platform and all content, features, and functionality are owned by Roq Networks Pvt Ltd and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content and applications you create using the Platform, subject to our right to use such content for Platform improvement and analytics purposes.

7. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. The use of AI-generated content may contain errors or inaccuracies, and users are responsible for reviewing and validating all generated content.

8. Limitation of Liability

No liability rests on the developers of DevelopApp and Roq Networks Pvt Ltd for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the liability.

9. Privacy Policy

Data Collection and Usage: We collect and process your personal information, including but not limited to your name, email address, usage data, and content you create on the Platform. Your data may be used to provide you better services, improve our Platform, and enhance user experience.

Third-Party Processing: We use third-party Large Language Models (LLMs) and AI services to process algorithms and generate content. These third parties may include but are not limited to OpenAI, Anthropic, Google, and other AI service providers.

Data Security: We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You acknowledge and accept that your information may be processed by third-party AI services as part of our Platform functionality.

Consent: By using the Platform, you explicitly consent to the collection, processing, and sharing of your information as described in this Privacy Policy section. If you do not agree to these terms, please do not use the Platform.

10. Service Availability

We strive to maintain Platform availability but do not guarantee uninterrupted service. We reserve the right to suspend or terminate the Platform for maintenance, updates, or other operational reasons. We are not liable for any losses resulting from Platform unavailability.

11. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, for violation of these Terms or for any other reason. Upon termination, your right to use the Platform will cease immediately, and any unused credits will be forfeited without refund.

You agree to indemnify and hold harmless Roq Networks Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
